HCHFA Compliance Statement
At Odette Confectionery, we believe in honesty, transparency, and trust. As a small-batch macaron bakery, we operate under Utah’s Home Consumption & Homemade Food Act (HCHFA) — a law that allows home-based food artisans to prepare and sell certain foods directly to consumers.
This page explains what that means for you as our valued customer.
Our Dedicated Confectionery Kitchen
All Odette Confectionery products are prepared in a dedicated secondary kitchen within our home, located in Layton, Utah.
This kitchen:
Is separate from our family’s main kitchen
Is used exclusively for baking and confection production
Is maintained with strict cleanliness and organization
Contains dedicated tools, equipment, and storage for our macarons
While this kitchen is not inspected by the Utah Department of Agriculture and Food, its sole purpose is the safe preparation of our macarons.
What the Home Consumption & Homemade Food Act (HCHFA) Means
Under HCHFA:
We are legally permitted to produce and sell homemade foods (including macarons) directly to consumers.
Our kitchen is not required to be state-inspected or certified as a commercial facility.
We may use a wider range of ingredients than Cottage Food Law allows (such as dairy-based ganaches and cream fillings).
We must sell directly to the end consumer — not to stores, cafés, or other resale locations.
We must provide accurate allergen information and transparent labeling upon request.
This law allows us to offer artisan-quality macarons with premium fillings, while still maintaining full legal compliance.
Direct-to-Consumer Sales Requirement
Because HCHFA requires that all food be sold directly to the consumer, we are able to offer:
Local pickup
Limited local delivery
Direct sales through our website or direct inquiry
We are not permitted to:
Wholesale to retailers
Sell through coffee shops or boutiques
Provide products for resale
Ship across state lines (interstate shipping restrictions apply under HCHFA)
We appreciate your understanding and support as we grow within this framework.
Ingredient Transparency & Allergen Disclosure
HCHFA requires full transparency regarding ingredients and allergens. We are committed to providing detailed information about:
Allergens present or potentially present
Ingredient lists upon request
Proper labeling for custom orders or packaged goods
Please visit our Allergen & Food Safety Policy for complete details.
Your Safety Matters to Us
Although our kitchen is not commercially licensed, we take pride in maintaining high standards:
Small-batch production for freshness and control
Clean, organized, dedicated workspace
Proper food handling and sanitation practices
Temperature-safe storage of dairy-based fillings
Careful separation of ingredients to avoid cross-contact where possible
Our goal is to offer the highest-quality macarons with clear, confident safety guidelines.
